INFORMATION TO DATA SUBJECTS PURSUANT TO ART. 13 OF LEGISLATIVE DECREE NO. 196 OF 30 JUNE 2003
The present document provides an outline of the way the personal data of BidADV’s website visitors are managed. The information to data subjects is provided according to the terms of art. 13 of the Italian Legislative Decree no. 196 of 30 June 2003 – Code for the protection of personal data (hereinafter “Privacy Code”). This information only applies to the website www.BidADV.com. It does not apply to any sites accessed via links.
The information also takes full account of EU Recommendation 2 /2001 “on certain minimum requirements for collection of personal data on-line in the European Union”. This consists in establishing the methods and time schedules the data processor must conform to, and the types of information data processors must provide to users accessing web pages, irrespectively of the reasons for accessing.
1.PURPOSE OF DATA PROCESSING. The processing of personal data: a) Is aimed at registration and at the management and correct fulfillment of purchase orders, as well as completion of the consequent administrative tasks, including accounting records and entries, the fulfillment of contractual relations and compliance with the obligations required by law or by European Community regulations and by the provisions issued by authorities designated for this purpose by law and by the supervisory and control bodies; b) Is aimed at elaboration of statistical studies and market research ; c) Is aimed at disclosure and assignment those data to third society carefully selected by BidADV S.r.l.
2.INTERNET NAVIGATION DATA. The ICT systems and the relative software procedures responsible for the functioning of this web site acquire personal information as part of their normal operation, the transmission of which is implicit in the use of internet communication protocols. This category of data includes, for example, IP addresses or domain names of the computers used by users to connect to our web site and other navigation information. This information is used by BidADV S.r.l. on an “anonymous” and “aggregate” basis exclusively for statistical purposes and for operation of the web site (for e.g., login pages, logout pages, etc.).
PROCESSING METHODS. The processing 3.DATA of data will take place within the limits and in accordance with the conditions set forth by Privacy Code. It is carried out through use of electronic or automated means and in compliance with the minimum security measures envisaged by the Privacy Code. It is carried out by the Data Controller and by employees and/or professionals empowered to do so by the Company BidADV, and who will perform the above mentioned activities. For this purpose, the data may be disclosed to internal/external collaborators of our Company external bodies which perform functions strictly connected and instrumental to service operations.
4.SUPPLY OF DATA. Providing personal data for processing under points 1.b and 1.c above is optional, while the supply of personal data for processing under point 1.a above is mandatory in order to proceed with registration and with providing the services requested.
5.DATA CONTROLLER. The Data Controller is the company BIDADV S.r.l., with registered office in Via Burlamacchi n. 6 – 20135 MILAN.
6. DATA SUBJECT’S RIGHTS. The interested parties have the right, at any time, to be informed of the existence of any such data, and to be informed of the content and origin of the said data. They have the right to check it for accuracy or to request additions or updating. They also have the right to correct such data according to the terms of art. 7 of the Privacy Code (find hereinafter the integral text). The individuals concerned have the right to request that the said data be deleted or rendered anonymous or, when their motives are legitimate, to oppose processing of the said data. Requests of this nature are to be addressed to the e-mail address support@BidADV.com or sent to BidADV S.r.l.- via Burlamacchi n. 6- 20135 Milan.
Right of access to personal data and other rights (according to art. 7 of the Privacy Code)
The individual has the right to receive confirmation of the existence or not of personal data of which he is subject, even if not yet registered, and communication of the same in intelligible form.
The individual has the right to receive indication: a. of the origin of personal data; b. of the purposes for and conditions in which said data is to be treated; c. of the logic applied in the case of treatment performed with the assistance of electronic methods; d. of the identity of the controller, the processors and the representative appointed under the terms of article 5, subsection 2; e. of the subjects and subject categories to which personal data may be communicated or which may receive such information while acting as national territory representative, processors or appointees.
The individual has the right to: a. update, modify or, if so desired, integrate the data; b. cancel, transform into anonymous format or block data treated in violation of the law, including that which it is not necessary to preserve in relation to the purposes for which said data was collected or subsequently treated; c. receive confirmation that procedures under letters a) and b) have been brought to the attention, also in relation to their content, to those bodies or persons to whom said data has been communicated or transmitted, except in the case in which such communication proves impossible or involves means manifestly disproportionate with respect to the right protected.
The individual has the right, wholly or in part: a. when his/her reasons are legitimate, to oppose to the treatment of data of which he is subject, even if pertinent to the purposes of the data collection; b. to oppose to the treatment of data of which he is subject for the purposes of issuing advertising or direct sales material or for market research or commercial communications.
